Australian Consumer Rights

Thank you for selecting NETGEAR products. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Under the ACL, a “consumer” is entitled to remedies, including a refund, replacement or a repair from the supplier of the goods if the goods are not of an acceptable quality.

When you purchase NETGEAR products, you may also receive coverage from NETGEAR’s limited hardware warranty. For further information about this warranty, please see. Our warranty is in addition to any rights you might have under the ACL.

Summary of rights under the ACL

When a consumer buys products and services, they come with automatic guarantees that they will work and do what you asked for (Consumer Guarantees).

The ACL requires that (taking into account the nature of the goods, the price, any representations made by the supplier or manufacturer and other relevant circumstances) the goods must be free of defects, do what they are meant to do, be safe, durable and acceptable in appearance and finish, be fit for any particular purpose that the consumer makes known and comply with any description given or any demonstration model used.

If a NETGEAR product fails to deliver any of these guarantees, you may be entitled to a remedy under the ACL.

What remedies are available

Under the ACL, the remedy you are entitled to if a product fails to meet a Consumer Guarantee will depend on whether the failure to comply with the guarantee is minor or major.

  • Major failures: where the fault is major or cannot be remedied, you may be entitled to reject the product and obtain a refund or replacement of the product.
  • Minor faults: where the fault is not a major failure, you may require the supplier to remedy the failure within a reasonable time. In these circumstances, the supplier is entitled to choose to repair or replace the goods or provide a refund.

You are responsible for returning the product to the supplier (including the cost of doing so) unless this cannot be done without significant cost because of the nature of the failure or the size, height or method of attachment of the product. However, you may be entitled to a refund of the reasonable costs you incur if the product is faulty.

How to claim a remedy under the ACL

Consumers with a claim under the ACL should contact the supplier of the goods at first instance.

Please note that rights to a repair, replacement, or refund may not apply if you:

  • got what you asked for but simply changed your mind, found it cheaper somewhere else, decided you did not like the purchase or had no use for it.
  • misused a product in any way that caused the problem.
  • knew of or were made aware of the faults before you bought the product.
  • asked for a service to be done in a certain way against the advice of the business or were unclear about what you wanted.
  • purchased the product at auction (including online auctions).
